Terms of Service — AI Travel Planning

Itinara AI (hereinafter "Itinara AI," "we," "us," or "our") is a service provided by Itinara AI Inc., a company incorporated under the laws of the United States, with its registered address at 123 Innovation Drive, San Francisco, CA 94105, United States. These Terms of Service ("Terms") govern your access to and use of our AI-powered travel planning service available at https://itinara.tech (the "Service").

By creating an account, subscribing to any plan, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on your own behalf or on behalf of any organization you represent.

⚠️ Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

1. Description of Service

1.1 Our Service

Itinara AI provides an AI-powered travel planning platform that generates personalized travel itineraries based on user-provided preferences. The Service includes:

The Service is a digital intangible product. Access is granted immediately upon payment confirmation. Due to the immediate delivery nature of digital services, refunds are subject to the limitations described in Section 7.

1.3 AI Model Disclosure

Itinara AI uses third-party AI model providers to generate travel itineraries and content. Our primary AI providers include DeepSeek for itinerary generation and content creation. The performance and availability of our Service may be affected by these providers' operational status. Significant disruptions will be communicated to users promptly. We do not guarantee specific output quality and are not responsible for content generated by third-party AI models.

2. User Accounts

2.1 Account Creation

To use Itinara AI, you must create an account with accurate and complete information. You are responsible for:

3. Subscription Plans and Billing (V1 — Subscription)

3.1 Subscription Plans

Itinara AI offers subscription plans for access to the Service. Current plan details and pricing are available at https://itinara.tech/pricing. We reserve the right to modify plan features or introduce new plans at any time. Price changes are governed by Section 3.4.

3.2 Auto-Renewal Authorization

By providing a payment method and subscribing to a paid plan, you expressly authorize Itinara AI Inc. to charge your payment method on a recurring basis for the applicable subscription fees. This recurring authorization remains in effect until you cancel your subscription per Section 6. Your subscription renews automatically at the end of each billing cycle unless you cancel prior to the renewal date. Annual subscribers will receive advance notice before renewal.

3.3 Payment Processing

All payment card data is processed exclusively by our PCI-DSS-compliant payment processor — Waffo Pancake — and is never stored on our servers. All charges appear on your statement as "Itinara AI" or "Waffo Pancake" for payment processing services.

3.4 Taxes

Unless otherwise stated, all prices exclude applicable taxes (including VAT, GST, sales tax, etc.). Where required by law, we will collect and remit the appropriate taxes.

3.5 Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before any price changes take effect. Price changes will be communicated via the email address associated with your account.

3.6 Billing Disputes

If you believe a charge is erroneous, please contact us at billing@itinara.tech before initiating a dispute with your bank or credit card company. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

4. AI Content and Intellectual Property

4.1 Ownership of Output Content

Subject to these Terms, AI-generated content created from your inputs ("Output Content") belongs to you. You may use Output Content for any lawful purpose permitted under Section 5.

4.2 Input Content License

By submitting content to the Service ("Input Content"), you grant Itinara AI Inc. a limited, non-exclusive license, used solely to provide the Service to you. We will not use your Input Content to train AI models without your explicit consent.

4.3 Third-Party AI Model Dependency

The Service relies on third-party AI model providers, including DeepSeek. Output Content may be influenced by these providers' models. We do not guarantee specific output quality and accept no responsibility for content generated by third-party AI models.

4.4 AI Output Accuracy

⚠️ AI-generated content may contain errors, inaccuracies, or outdated information. You are responsible for reviewing and verifying all AI-generated content before relying on it — particularly for travel decisions. Do not use AI-generated content as a substitute for professional travel advisory services.

You may only use the Service for lawful purposes consistent with these Terms, including personal travel planning, business productivity, research, and development activities.

Account data is retained for 90 days after cancellation, after which it is deleted.

9. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any express or implied warranties, including merchantability, fitness for a particular purpose, or AI output accuracy.

9.2 AI Content Disclaimer

9.3 Limitation of Liability

To the maximum extent permitted by applicable law, Itinara AI Inc. shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Term and Termination

These Terms remain in effect for as long as you use the Service. We may suspend or terminate your account immediately, without prior notice, if you materially breach these Terms, engage in fraudulent or illegal activity, or when required by law. If we terminate the Service for reasons not attributable to your breach, you will receive a pro-rata refund for any prepaid, unused period. You may delete your account at any time by contacting support@itinara.tech.

11. Applicable Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Before initiating formal proceedings, please contact us at legal@itinara.tech to attempt informal resolution. Disputes that cannot be resolved informally shall be submitted to binding arbitration in San Francisco, California, under the rules of the American Arbitration Association.

12. General Provisions

We may update these Terms at any time. Material changes will be communicated at least 14 days in advance via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the revised Terms. If any provision is found invalid, the remaining provisions remain fully effective. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Itinara AI Inc.
